1. Promotions and Offers

At ESelf Storage UAE, all promotions and special offers are subject to change without prior notice. Offers are applicable only on selected storage units and depend on availability. Discounts and promotional pricing apply exclusively to the rental fee. Additional charges, including administrative fees, taxes, and other service fees, may apply. Please refer to the individual rental agreement for full details.

New Customers Only: Unless otherwise specified, promotions are available exclusively to new customers. Discounts do not apply to unit transfers or additional spaces rented.

Price Changes: Pricing is subject to change at any time. A reservation is required to secure promotional pricing. However, reservations only guarantee the price and do not guarantee the availability of a specific unit.

Unit Size Estimates: It should be noted again that the given unit dimensions are approximate. Sizes may vary in real-estate commercialization units. Therefore, we advise that you physically assess the unit before signing your lease agreement.

Online Reservations: Discounted pricing is available only for reservations made through our website or mobile app. If you are unsure about the size you need, don’t worry—online pricing discounts will still apply for rentals initiated via an online reservation.

We strive to accurately describe all products, services, and offers provided on our website. However, errors may occasionally occur. We do not guarantee that all specifications, descriptions, or pricing details are complete, accurate, or current. In the event of a pricing or specification error, ESelf Storage UAE reserves the right to refuse or cancel any reservations or orders at its sole discretion. If a charge has been made to your credit card before cancellation, we will issue a credit for the total amount.

Availability of products and services is not guaranteed. Items or services displayed on our website may be substituted or discontinued at any time without notice. ESelf Storage UAE reserves the right to modify pricing and billing methods at any time, with immediate effect upon posting on our website or via email notification to you.

By voluntarily providing your phone number to ESelf Storage UAE, you expressly consent to receive prerecorded voice messages, automated calls, or text messages from us regarding promotions, your account, any transactions, and other related services. You also agree that ESelf Storage UAE may use email addresses, mailing addresses, and phone numbers you provide or obtain through lawful means such as skip tracing. These communications may include reservation confirmations, account updates, and payment collections. You agree to receive these calls and messages even if you cancel your account or end your relationship with us unless you opt out as described below. You agree that all agreements, notifications, disclosures, and other communications sent electronically meet any legal requirement for written communications.

The ESelf Storage UAE SMS Program sends updates and promotional messages about our services. You may cancel this service at any time by texting “STOP.” You will receive a confirmation message, and no further messages will be sent. If you wish to rejoin, simply sign up again as you did initially. If you encounter issues, reply with “HELP” for support. 9. Copyright Complaints Procedure

ESelf Storage UAE reserves the right not to respond to reports that do not comply with the outlined requirements. We may also take down any content that appears to infringe on copyrights based on our discretion.

Notice: Knowingly providing false information about alleged copyright infringement may result in legal consequences.

If you believe that your content was wrongly removed due to a copyright claim, you can submit a counter-notice. Your counter-notice must include:

You acknowledge that your use of the Service is at your own risk. If you are dissatisfied with any part of the Service, your sole remedy is to discontinue its use. Please note that certain jurisdictions may not allow limitations on liability, and in such cases, the limitations above may not fully apply to you. Under applicable law, you may have additional rights beyond those outlined here. If any portion of this limitation of liability is found to be invalid or unenforceable, the total liability of ESelf Storage UAE in such instances will not exceed one hundred dollars ($100).

By using our Service, you agree that each provision related to the limitation of liability, disclaimers, and exclusion of damages is a fundamental part of the agreement between you and ESelf Storage UAE, and these limitations shall apply even if a specific remedy fails its essential purpose.

14. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold ESelf Storage UAE and its affiliates harmless from any and all claims, damages, losses, costs, investigations, liabilities, judgments, fines, penalties, settlements, interest, and expenses (including legal fees) that may arise directly or indirectly from any claim, lawsuit, action, demand, or proceeding initiated against ESelf Storage UAE, or as a result of the investigation, defense, or settlement of such matters, including but not limited to:

1. Your User Submissions.
2. Your use of the Service and any activities related to the Service.
3. Any breach or alleged breach of these Terms or any Additional Terms by you.
4. Violation or alleged violation of any laws, regulations, codes, statutes, or orders of any governmental authority related to your use of the Service or activities connected with the Service.
5. Any content or information transmitted through your device, even if not submitted by you, that infringes or misappropriates any copyright, trademark, trade secret, patent, publicity, privacy, or any other right of any individual or entity.
6. Any false or misleading representation you made.
7. Use of information or content submitted by you (including User Submissions) by ESelf Storage UAE.

You agree to fully cooperate with ESelf Storage UAE in the defense of any claims and losses. However, ESelf Storage UAE reserves the exclusive right to handle, settle, and resolve any claims or losses at its sole discretion. You may not settle any claims or losses without obtaining prior written consent from an authorized officer of ESelf Storage UAE.

15. Governing Law

This Service is operated and managed by ESelf Storage UAE. Therefore, the laws of the United Arab Emirates (UAE) will govern these Terms and all promotions or offers without consideration of any conflict of law principles. ESelf Storage UAE reserves the right to modify its Service, disclaimers, terms, and conditions at any time.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue to be in effect. Should any provision be considered unlawful, void, or unenforceable, it will be treated as separate from these Terms, ensuring the validity and enforceability of the remaining clauses.

17. Termination

ESelf Storage UAE reserves the right, at its sole discretion, to terminate your account and limit your use of any part of the Service, with or without reason and without prior notice or liability. Additionally, ESelf Storage UAE may block access from certain IP addresses or devices to prevent use of the Service. These Terms remain in effect even if your account is terminated.

18. Arbitration Agreement and Class Action Waiver

IMPORTANT: PLEASE READ THIS SECTION CAREFULLY, AS IT AFFECTS YOUR LEGAL RIGHTS.

18.1 Notice and Resolution Process

Before initiating any legal claim or proceeding against ESelf Storage UAE, you agree to first attempt to resolve the dispute informally. You must notify us of your claim by sending an email to info@eselfstorageuae.com or by writing to our Dispute Resolution Department in Dubai, Ajman. Your notice must clearly state the nature of the dispute and the remedy you are seeking. We will have 60 days from the receipt of your notice to try to resolve the issue with you. If the matter is not resolved within this time frame, either party may initiate a formal claim.

18.2 Dispute Resolution and Arbitration

You and ESelf Storage UAE agree that any dispute, claim, or controversy arising from or related to the use of our Service, including any contractual relationship, will be resolved through mandatory and binding arbitration rather than in court. By choosing arbitration, both parties waive the right to a trial before a judge or jury. The arbitrator has the authority to determine his or her own jurisdiction, including any disputes over the validity of the arbitration agreement. The arbitration process is less formal than court proceedings, with limited discovery. The arbitrator must adhere to this agreement and may award the same relief as a court but cannot issue declaratory or injunctive relief for anyone other than the parties involved. This arbitration agreement will survive the termination of the Service agreement.

18.3 Arbitration Rules

The arbitration shall be conducted in accordance with the UAE’s arbitration laws, specifically under the UAE Federal Arbitration Law (Federal Law No. 6 of 2018). A single arbitrator with experience in commercial contract disputes will be selected. The arbitration process will take place in the UAE, and the arbitration language will be English. If the total value of claims and counterclaims is less than AED 100,000, the arbitration may proceed as a documents-only hearing unless both parties agree otherwise in writing.

18.4 Exceptions

Despite the arbitration requirement, both parties retain the right to bring individual claims to the UAE Small Claims Tribunal for disputes that fall within its jurisdiction. Additionally, ESelf Storage UAE reserves the right to pursue legal actions to enforce liens, evictions, or other claims related to unpaid fees in any competent court within the UAE. This arbitration agreement does not prevent either party from raising issues with relevant UAE regulatory authorities or government agencies.

18.5 Waiver of Class and Representative Actions

Both you and ESelf Storage UAE agree to waive any right to a jury trial or to participate in a class action lawsuit. All claims must be brought individually, and neither party may act as a plaintiff or class member in any consolidated or representative legal proceeding. If this waiver is found to be unenforceable, then the entirety of this arbitration clause will be considered void, except for the provisions outlined in Section 18.1, which will remain in effect.

19. General Terms

These Terms represent the entire agreement between you and us regarding the use of our Service, overriding any previous or concurrent communications, proposals, or agreements (whether verbal, written, or electronic) on the subject matter. No joint venture, partnership, employment, or agency relationship is established between you and us as a result of these Terms or your use of the Service. You are solely responsible for obtaining and maintaining any devices, software, internet services, and other related services needed to access and use our Service, including all associated charges.

Our decision not to enforce any right or provision of these Terms does not constitute a waiver of that right or provision. If any provision of these Terms is found to be illegal, void, or unenforceable, it will be removed from these Terms without affecting the enforceability of the remaining provisions. These Terms shall not be altered by any trade practices or previous actions between the parties. We may transfer our rights and obligations under these Terms to any party at any time without notice. However, you may not transfer your rights and obligations under these Terms without our written consent.

The obligations and rights specified in these Terms, including licenses granted to us, as well as indemnities, disclaimers, limitations on liability, and clauses related to jurisdiction and arbitration, will remain in effect even after you stop using the Service or your account is terminated. These Terms do not grant any third party any rights or claims. Where the context requires, the singular form includes the plural, and vice versa, and the word “or” is used inclusively (meaning “and/or”). The term “including” is meant to provide examples without limiting the scope of the preceding description. Headings in these Terms are provided for convenience and do not affect the interpretation of any provision.

20. Terms Specific to Our Mobile App

A. General App Terms

As part of the services offered, our company may provide a mobile app (“App”) that allows users to remotely access and control certain features related to our facilities and services. The App may collect data related to its usage and your activities. It is your responsibility to ensure the App is correctly installed on your device. We are not liable for any issues arising from App malfunctions, including disruptions in accessing facilities or conflicts with other software. You are also responsible for maintaining internet or mobile connectivity when using the app, and we are not responsible for any connectivity issues or interruptions.

The App may automatically update with new features or improvements, and by using the App, you consent to receive and install these updates without additional notice. We reserve the right to change the App and its features at any time without notice. If you do not agree with any changes, your only option is to stop using the App. Continued use of the App indicates your acceptance of these changes.

While there may be no charge for using the App currently, we reserve the right to introduce fees in the future for new features, services, or apps. Third-party services that are compatible with our App may also have their own charges, for which you are solely responsible. Please be aware that any service or device connected to the internet may face risks like hacking, viruses, or malicious activities. We are not liable for any third-party misconduct via the internet that may affect your device or our service. The App’s functionality may be disrupted if your internet, mobile connection, or device malfunctions.

B. Additional Terms for Apple Device Users

If you are using our App on a device manufactured by Apple Inc. (“Apple Device”):

1. These terms are solely between you and our company, not Apple, except where Apple acts as a third-party beneficiary, as outlined here.
2. Your use of the App must comply with Apple’s App Store Terms and Conditions and any relevant third-party agreements.
3. Our company, not Apple, is solely responsible for providing the App and its content.
4. Apple has no obligation to provide maintenance or support services for the App.
5. Apple offers no additional warranties for the App beyond those legally required.
6. If you have claims related to product liability, regulatory compliance, or consumer protection, our company—not Apple—is responsible for handling these claims.
7. If the App infringes on third-party intellectual property rights, you agree that Apple is not responsible for resolving these claims.
8. Apple and its subsidiaries are third-party beneficiaries of these terms, and by accepting them, you agree that Apple has the right to enforce these terms against you.
9. You must comply with any third-party terms applicable to any platform or service that interacts with our App.
10. You represent and warrant that: (a) you are not located in a country subject to international sanctions or embargoes as recognized by the UAE government, and (b) you are not listed on any UAE government or international authorities’ list of prohibited or restricted parties.
